terms of service

Last updated: November 4, 2026 ·

These Terms of Service (“Terms”) govern your use of notfromhere for business — the subscription dashboard on the web and in the notfromhere app — and of this website, including its free public pages (together, the “Service”), operated by [Operator legal name] (“we”, “us”). By creating an account, submitting a sign-up, or otherwise using the Service, you agree to these Terms. If you are signing up for a business, you agree to them on behalf of that business, and “you” means both you and the business. If you do not agree, please do not use the Service.

1. what the service is

notfromhere for business is a paid subscription for local service businesses. It shows your business’s services and prices next to those of competitors around you, and includes: a live map of competitors’ prices, price comparisons and distributions by service, price recommendations, suggestions for services your competitors offer and you do not, competitor alerts, a market view built for any competitor from public information (not that competitora view of the dashboard as any competitor would see itrsquo;s own account), sales and insights built from figures you enter, and an AI assistant. Features may differ between the web dashboard and the app, and we may add, change, or remove features over time (Section 13).

This website also has free public pages, including a public price map, that anyone can use without an account. Sections 5, 9, 10, 12, and 14 to 22 apply to them as well.

2. who can sign up

The Service is for business use only, not for personal or household use. To sign up, you must be at least 18 years old and the owner of the business you sign up for, or authorized to act for it and to accept these Terms on its behalf. The details you give us about yourself and the business must be accurate and kept up to date. You confirm this when you sign up. We may ask you, before or after your subscription starts, to show that the business is yours, and may pause your access until you do. A false claim to a business ends your account without refund, and we may also end an account we cannot verify or reasonably believe was created fraudulently.

3. your account

Your account is linked to the business you sign up for, and to any additional locations of it included in your plan. There is no password: you log in with a one-time code sent to your email address, so you are responsible for keeping access to that email account secure and for all activity under your account. You may let members of your business’s staff use the account on your behalf; you are responsible for their use of it, as for your own. Do not share the account or a login code with anyone outside your business. Tell us right away at [contact email] if you believe your account has been accessed without your authorization.

4. subscription, billing & renewal

The Service is a paid, recurring subscription, billed monthly or yearly depending on the plan you choose. The price for your market and plan, and how it renews, are shown to you before you sign up, and you confirm them when you do. Your subscription starts, and you are charged for the first billing period, when you complete payment at sign-up; your access to the dashboard and the app starts as soon as the payment is confirmed.

Your subscription then renews automatically at the end of each billing period, at the price for your plan at that time, and you are charged for each new period, until you cancel. A yearly plan is paid upfront: the whole year is charged at once, at the start of each year. Prices do not include taxes, which are added where required. Payments are handled by our payment processor; we do not see or store your full card details.

If a payment fails, we will let you know by email and retry it, and your access may be paused until it is resolved. If a payment remains unpaid 14 days after it was due, we may end your subscription. If you dispute a charge with your bank or card issuer without first contacting us to resolve it, we may suspend your account while the dispute is open.

You can cancel at any time from the settings of your dashboard, on the web or in the app, or by contacting [contact email]. Cancellation takes effect at the end of your current billing period: you keep access until then and will not be charged again. Cancelling a yearly plan does not refund the remainder of the year you have already paid for, and we do not provide refunds for partial billing periods, except where required by law (or as described in Sections 13 and 18).

We will tell you by email at least 30 days before any price increase applies to you, so you can cancel before it does, and we never raise the price of a period you have already paid for. On a yearly plan, we will also remind you by email about 30 days before each renewal, with the date, the price it will renew at, and how to cancel.

Renewal refunds. We will refund a yearly renewal in full if we did not send you the reminder described above. If your business is in New York and our reminder reached you only by email, you may cancel within 30 days of the renewal charge for a full refund of that renewal.

5. where the data comes from

Competitors’ services, prices, and business details are gathered automatically from public sources — mainly businesses’ own websites, and open map and places datasets — in many cases with the help of AI tools that read service names and prices from those websites. They are not verified by us in real time. A price can change or be out of date, an AI tool can read something wrong, a business can be missing or listed under the wrong category, and how many competitors we cover differs from area to area. Nothing on the Service is a quote, an offer, or a guarantee of any price. Confirm anything important directly before relying on it.

6. recommendations, insights & the AI assistant

Price recommendations, service suggestions, insights, and answers from the AI assistant are generated automatically from the data described in Section 5 and the figures you enter. They are information to help you think, not financial, legal, tax, or professional advice, and they can be wrong. You decide your own prices and services and are responsible for those decisions.

Use the Service to make your own, independent pricing decisions. Do not use it to agree on or coordinate prices with competitors, or in any other way that breaks competition (antitrust) law.

Recommendations are suggestions only and never binding: nothing in the Service sets or applies a price for you. They are built from prices businesses publish themselves and from your own figures; your Private Data (Section 7) is never used in what other subscribers see. Do not use the Service to share prices you haven’t published, or other non-public information, with competitors. We may suspend or end an account that uses the Service this way.

7. your data

Private Data. Service cost information, sales figures, and alert settings that you enter in the Service (“Private Data”) are confidential to your account. We do not disclose Private Data to other subscribers or display it on the public pages, and we process it solely to provide the Service to you, in accordance with our Privacy Policy.

Listing Data. Services, prices, and business details that you add or modify through the Service (“Listing Data”) update your business’s listing. Listing Data, together with your business’s name, location, contact details, and the services and prices collected from public sources (collectively, “Market Data”), is made available to other subscribers, including through the competitor view of the dashboard, and may in part be displayed on the public pages. Other businesses’ Market Data is made available to you on the same basis. By submitting Listing Data, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and use it for these purposes. Listing Data stays part of your business’s listing after your account ends, and this license continues for it, until you request its correction or removal as described in Section 10.

You confirm that the Listing Data you submit is true and up to date and reflects what your business actually offers and charges. Do not submit prices or details that are false or misleading, for example to change how your business, or your competitors, appear in comparisons. We may correct, hide, or remove Listing Data that we reasonably believe is inaccurate.

8. using competitor & market data

You may use what you see in the Service for your own business’s internal purposes. You may not resell, sublicense, or publish it, offer it as part of another product, or use it to harass, mislead, or unlawfully contact other businesses or their customers.

9. acceptable use

When using the Service, you agree not to:

  • Attempt to bypass, disable, or circumvent any security, authentication, access, or rate-limiting measure;
  • Use automated means (scraping, bots, scripts) to extract data from the Service, or to bulk-harvest the public pages;
  • Share your account or login codes with anyone outside your business, or access another business’s account or private data without authorization;
  • Copy, reverse engineer, or build a competing product from the Service;
  • Enter personal information about your customers, staff, or other individuals into the Service, including the AI assistant — it is built for business figures (such as prices, costs, and sales counts), not for personal data;
  • Use phone numbers or email addresses from the Service to make automated or prerecorded calls, send text messages, or send bulk email to listed businesses, or to contact them in any way that breaks telemarketing or anti-spam laws (such as the TCPA or CAN-SPAM);
  • Use the Service for any unlawful purpose, or in a way that could disable, overburden, or impair it for others.

10. corrections, removal & reporting content

Any business owner, subscriber or not, who believes their business’s information is inaccurate or out of date, or who wants it removed, can ask through the “remove my business” page on this website or by contacting us at [contact email]. We review every request and will reply to confirm what we did. A business that is removed can no longer be compared against, including by its own subscription.

Reporting illegal content. Anyone can tell us that something on a listing is illegal, through the “report illegal content” page on this website (also linked from every business on the map) or by email to [contact email]. Say where it is, why you believe it is illegal, and give your name and email, with a statement that your report is accurate and made in good faith. We confirm that we received it, a person reviews it, and we tell you what we decided and how to object.

How we restrict content. We may hide, correct or remove Listing Data, or suspend an account, when it is illegal or breaks these terms. A few checks are automatic: a price far outside what comparable businesses charge is held back from comparisons until it is checked, a price of 1 or less with no unit is not shown, and a change to a listing’s phone, website or email waits 48 hours with a notice to the old contact. Everything else is decided by a person.

When we restrict your content we tell you by email what we restricted, why, on which ground, and whether it was decided automatically. If you disagree, reply and a person will look at it again; you can also go to a court or to an out-of-court dispute settlement body certified under the EU Digital Services Act.

Point of contact. [contact email] is our single point of contact for users and for authorities under the EU Digital Services Act. We answer in English.

11. the app

The notfromhere app is offered through Apple’s App Store and Google Play, whose own terms also apply to how you download and update it. These Terms are between you and us only: Apple and Google are not responsible for the app or its content. The app uses the same account and subscription as the web dashboard.

12. intellectual property

The Service’s own design, code, software, branding, and the analyses it produces belong to [Operator legal name]. Business and pricing information gathered from public sources remains the information of those businesses and sources — we do not claim ownership over it — and map data is credited to its providers where it is shown. If you send us suggestions or feedback about the Service, we may use them freely, without any obligation to you.

13. changes to the service

We work to keep the Service available and accurate, but it may sometimes be unavailable, for example for maintenance. We may add, change, or remove features, or stop offering the Service. If we make a change that materially reduces what your current plan includes, or stop the Service, we will tell you by email in advance where we can, and you may cancel; if we stop the Service, we will refund the unused part of any period you have already paid for.

Features we mark as “beta” or “preview” are offered early so you can try them: they are provided as is, may be incomplete or inaccurate, and may change or be removed at any time.

14. copyright complaints (DMCA)

If you believe material on the Service infringes your copyright, send a written notice to our designated agent that includes: (a) your signature (physical or electronic); (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material you claim is infringing, with enough detail for us to locate it; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized; and (f) a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act on the copyright owner’s behalf.

Designated agent: [DMCA agent name], [DMCA agent mailing address], [DMCA agent email]. We will remove or disable access to material that we determine, in good faith, infringes a valid copyright claim, and will notify the party who posted or supplied it where we are able to.

15. disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY INFORMATION, RECOMMENDATION, OR INSIGHT ON IT IS ACCURATE OR CURRENT, OR THAT USING IT WILL PRODUCE ANY PARTICULAR BUSINESS RESULT.

16. limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, [OPERATOR LEGAL NAME] SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR CUSTOMERS, ARISING FROM YOUR USE OF THE SERVICE OR ANY PRICING OR OTHER BUSINESS DECISION MADE BASED ON IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, [OPERATOR LEGAL NAME]’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED US DOLLARS ($100). NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED BY LAW, AND NOTHING LIMITS OUR LIABILITY FOR FRAUD, WILFUL MISCONDUCT, INTENT, DELIBERATE RECKLESSNESS, OR GROSS NEGLIGENCE.

17. indemnification

You agree to indemnify and hold [Operator legal name] harmless from any claim, loss, or demand (including reasonable attorneys’ fees) made by a third party arising from your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

18. ending your account

You can cancel your subscription (Section 4) or ask us to delete your account at any time, from the settings in the app or by contacting [contact email]; we will confirm by email once it is done. We may suspend or end your account for a serious or repeated violation of these Terms, for non-payment, or as required by law, with notice where practical. We may also end your account for any other reason by giving you at least 30 days’ notice by email; in that case, we will refund the unused part of any period you have already paid for. When your account ends, your access to the dashboard and the app ends, and your data is handled as described in our Privacy Policy. Sections of these Terms that by their nature should survive — including Sections 5 to 8, 12, and 15 to 22 — will survive.

19. changes to these terms

We may update these Terms. Material changes will be reflected here with an updated “Last updated” date, and we will tell active subscribers by email at least 30 days before they take effect; on a yearly plan, they take effect for you at your next renewal, unless they are required by law sooner. Continuing to use the Service after a change takes effect means you accept the updated Terms, and we will also ask you to agree to them in the dashboard and the app; if you do not, you can cancel before then.

20. governing law

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any dispute arising from these Terms or the Service will be submitted exclusively to the District Court of Amsterdam (Rechtbank Amsterdam), unless mandatory law provides otherwise. We may also bring a claim against you in the courts where you are established.

21. general

If any provision of these Terms is found unenforceable, the rest of these Terms remain in full effect. These Terms, with the price and plan you confirmed when signing up, are the entire agreement between you and [Operator legal name] regarding the Service, and supersede any prior agreements on the same subject. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce any provision is not a waiver of it.

Force majeure. We are not liable for any delay or failure to provide the Service caused by events beyond our reasonable control, such as failures of hosting, network, payment, or other third-party services, power outages, natural disasters, or government action.

Notices. We send notices to the email address of your account; you send them to [contact email]. A notice sent by email counts as written notice.

Language. These Terms are written in English. If they are translated, the English version prevails.

22. contact

You may ask questions about these Terms by contacting [contact email].
